General Terms and Conditions of Schloss Esterházy Management GmbH

Regarding private group reservations in Schloss Esterházy in Eisenstadt

1. Scope

1.1 These general terms and conditions apply to all contracts concluded by Schloss Esterházy Management GmbH (hereinafter referred to as “SEM”) for the reservation of private groups.

Supplementary or differing agreements, such as in particular GTC [general terms and conditions] of the customer, must have recognition from SEM that is in written form and signed by the company to be legally valid. These GTC also apply even if SEM does not expressly refer to them for later contracts.

1.2 We distinguish between the following types of private groups: 1. Private groups with audio guides or tour descriptions (included in the entrance fee). 2. Guided private groups.

1.3 Guided tours may be conducted exclusively by SEM’s own guides or by accredited third-party guides.

1.4 Visitors to Schloss Esterházy undertake to comply with the house rules for the display rooms visited. The house rules can be viewed on the website and are on display on site in the ticket shop. For groups of children, the accompanying adults shall bear responsibility for the group.

2. Booking conditions

2.1 Bookings are accepted exclusively in writing or with a booking form for private guided tours. If you would like to reserve places on a public fixed-time guided tour, please contact us by telephone or email.

2.2 The size of the group is limited; greater numbers of people will be split up into separate groups for the guided tour. A change in the

maximum group size or a cancellation at short notice is possible at any time requirements.

2.3 We will look into requested dates depending on availability. The visitors will then receive a binding reservation in the form of a reservation confirmation that contains all of the important information via email to the visitor’s stated email address.

3. Changes and cancellation

3.1 Tickets reserved for tours without a guide (that is, using an audio guide) can be changed or cancelled at no cost at any time by telephone on 02682/630047600 or email (ausstellung@esterhazy.at).

3.2 Changes to private guided tour reservations can be made only according to availability.

3.3 The definite number of people on the tour must be announced in writing by email to ausstellung@esterhazy.at or by phone on 02682/63004-7600 no later than 3 business days before the visit date. The admission fees for the specified number of persons will be charged.

3.4 If the booking cannot be kept at the agreed time, it must be cancelled in writing at least 3 days (72 hours) before the agreed date. If a written cancellation is made within 24-72 hours before the booked date, 50% of the full price will be charged to the provide contact address. For cancellations within 24 hours before the agreed date or in case of no-show without written cancellation, the full price will be charged.

SEM is entitled to withdraw from the contract for cause without setting a grace period. In the event of such a cancellation, the contractual partner is not entitled to any compensation from the SEM.

4. Collection / payment terms

4.1 Only the customer or a person authorised by the customer may collect the reserved tickets by stating the name of the group at the till.

4.2 The reservation or order (e.g. number of people and tour) may only be changed no later than upon collection of the tickets at the till. Once the order is concluded (payment has been made), no more changes may be made.

4.3 The entire amount may be paid in cash or with a debit or credit card only when the tickets are collected at the till.

4.4 Contracting parties with a valid voucher agreement may be invoiced as per the terms and conditions in the agreement. Unless agreed otherwise in writing, invoices issued by SEM are due for payment within 14 days of the invoice date. In case of delayed payment, 14% default interest p.a. is considered to be agreed. In case of default, the customer is also obliged to compensate SEM for the necessary costs of adequate collection and recovery measures.

As regards these costs, the estimates and charges of the Austrian Attorney’s Rate Act [Rechtsanwaltstarifgesetz] are considered to be appropriate and agreed.

4.5 In the event of delays of more than 15 minutes, the customer can no longer demand that the guided tour take place as planned

5. Prices

5.1 Prices are understood to include VAT per person and can be viewed on the website. Prices are subject to change. Reduced group prices are applicable for groups of 15 or more.

5.2 When reduced prices are claimed (such as for children, pupils and students), proof justifying the discount must be presented at the till.

5.3 Prices cannot be reduced for holders of the Burgenland-Card, Niederösterreich-Card or Steiermark-Card when group bookings are made.

5.4 The following persons will receive free tickets:

-For groups of 15 or more, the tour guide (as the 16st person) receives free entry.

-For school and student groups, one accompanying adult per 10 pupils receives free entry. Additional accompanying adults must pay the adult fee.

-Austrian tour guides with tour guide ID cards receive free entry. The discount for disabled visitors applies only with a valid ID card. A carer to a blind visitor or wheelchair user may enter for free provided that a carer is noted on the ID card

5.5 Liability for lost profit, consequential damages or damages based on claims of third parties is excluded.

6. Final Provision

Changes or supplements, if any, must be made in writing to be legally valid; this also applies to a departure from this written form requirement.

Should one or several provisions of these GTC be partially or entirely void, this will not affect the effectiveness of the remaining provisions. A void or impermissible provision must be replaced by another valid provision that corresponds most closely with the commercial and legal sense and purpose of the provision being removed.
